CHAPTER 12 TRADE IN SERVICES
(第12章 サービス貿易)
Article 12.1: Definitions
(第1条 定義)
For the purposes of this Chapter:
commercial presence means any type of business
or professional establishment, including through:
(この章において、｢商業拠点｣とは、以下の行為によるものを含む、
あらゆる種類の事業所又は専門施設を意味する。)
(a) the constitution, acquisition or maintenance of a legal person; or
((a) 法人の設立、買収又は維持。又は、)
(b) the creation or maintenance of a branch or a representative office,
within the territory of a Party for the purpose of supplying a service;
enterprise means an enterprise as defined in Article 2.1
(Definitions of General Application), and a branch of an enterprise;
measures adopted or maintained by a Party means measures adopted or
maintained by:
((b) サービスの提供を目的とした加盟国の領域内での、
支店又は代理店の作成もしくは維持。
｢企業｣とは、第2章第1条（一般的定義）に規定する企業、
並びに企業の支店を意味する。
｢加盟国が採択又は維持する措置｣とは、
以下の存在が採択又は維持する措置を意味する。)
(a) central or local governments and authorities; and
((a) 中央又は地方の政府及び機関。並びに、)
(b) non-governmental bodies in the exercise of powers
delegated by central or local governments or authorities.

Such measures include measures affecting:
(当該措置は以下の事項に影響を与える措置を含む。)
(a) the production, distribution, marketing, sale, and delivery of a service;
(b) the purchase or use of, or payment for, a service;
(c) the access to and use of distribution, transport,
or telecommunications networks and services in
connection with the supply of a service;
(d) the presence, including commercial presence
in its territory of a service
supplier of another Party; and
(e) the provision of a bond or other form of
financial security as a condition
for the supply of a service;
((a) サービスの生産、流通、マーケティング、販売及び納入。
(b) サービスの購入、利用、又は支払。
(c) サービス提供に関連した流通・輸送・通信ネットワークへの
アクセス及び利用。

service supplied in the exercise of governmental
authority means any service which is supplied neither
on a commercial basis nor in competition with one or
more service suppliers;
(｢政府権限の行使として供給されるサービス｣とは、商業ベースでもなく、一つ以上のサービス提供者との競争によることもなく、供給されるサービスを意味する)
service supplier of a Party means a person of
a Party that seeks to supply or supplies a service;
(｢加盟国のサービス提供者｣とは、サービスを供給する、
又は供給しようとする加盟国の人を意味する。)
specialty air services means any non-transportation
air services, such as aerial fire fighting, sightseeing,
spraying, surveying, mapping, photography, parachute
jumping, glider towing, and helicopter-lift for logging
and construction, and other
airborne agricultural, industrial, and inspection services;
(｢特殊航空サービス｣とは、非空輸サービス（例：空中での消火活動、観光、散布、測量、地図作成活動、写真撮影、パラシュート・ジャンピング、グライダー曳航、伐木搬出及び建設用のヘリコプター･リフト、並びに他の空中での農業サービス、工業サービス、及び調査サービス）を意味する。)
state enterprise means an enterprise that is owned, or controlled through
ownership interests, by a Party;
(｢国営企業｣とは、加盟国が持分権を通して所有又は
管理する企業を意味する。)
trade in services or supply of services means the supply of a service:
(｢サービスの貿易｣又は｢サービス提供｣とは、
以下の方式のサービスの供給を意味する。)
(a) from the territory of one Party into the territory
of another Party (“crossborder mode”);
((a) いずれかの加盟国の領域から別の加盟国の領域への
サービスの供給（越境方式）)
(b) in the territory of one Party by a person of that Party to a person of
another Party (“consumption abroad mode”);
((b) いずれかの加盟国の領域における、
その加盟国の人により別の加盟国の人に対して行われる
サービスの供給（外国消費方式）)
(c) by a service supplier of one Party, through commercial presence in the
territory of another Party (“commercial presence mode”); or
((c) いずれかの加盟国のサービス提供者により、
別の加盟国の領域における商業拠点を通じて
行われるサービスの供給（商業拠点方式）又は、)
(d) by a national of a Party in the territory of another Party
(“presence of natural persons mode”).
((d) 加盟国の国民による別の加盟国の領域でのサービスの供給（自然人存在方式）)

これだけで他のTPP加盟国から日本が
食い物にされるってのが丸分かりですよｗｗｗ
しかし、今まで書いてきたことに加えて、
結構重要なレベルのサービスまで開放して自由化していくわけですから、
これはシャレになりませんよ。
一番個人的に怖いなと思ったのはサービスの
通信ネットワークを利用するってことですね。
これは明らかに普通の企業や金融機関などの
情報も自由に見れる可能性があるかもしれないってことですから。
つまり今まで以上に金融機関などに登録した個人情報だって
抜かれる可能性をも示唆しているわけで。
それを除いても、ここまでハードルを下げたら、
いくらでも外資や外国人が入り込んで、日本の資産が
食い物にされるっていうのがよく分かってしまうわけで。
何でこういう大事な情報を日本語で公開しないのか、
自分には理解ができませんよ。
次に第2条の「目的」を転載しましょう。

(第2条 目的)
The objectives of this Chapter are to facilitate expansion
of trade in services on a mutually advantageous basis,
under conditions of transparency and progressive liberalisation,
while recognising the rights of Parties to regulate services,
including to introduce new regulations, and the role of governments
in providing and funding public services,
giving due respect to national policy objectives including
where these reflect local circumstances.
(この章の目的は、国策目標に（それが地域の実情を反映する場合を含めて）
然るべき敬意を払いながら、公共サービスの出資と提供における政府の役割
並びに、サービスを規制するための加盟国の権利（新たな規則の導入を含む）
を承認する一方で、透明性及び漸進的自由化を条件として、
相互に有益な方式でサービスの貿易の拡大を促進することである。)

何でここまで明確に述べられてるのに
反対しないんだって話ですよ
これは前回まで解説した、第11章の項目に関わってくることなんですが、
政府や地方自治体の公共事業に対して、日本企業だけじゃなくて、
その他のTPP加盟国が入札に食い込んでくるわけですから、
日本の儲けには一切ならないわけです。
自分みたいな素人でもこれくらいのことは分かるんで、
プロの方だったらもっと分かるはずなんですが、
どうもテレビに出ている御用学者は(ry
おっとまた余計なことを書いてしまいましたｗｗｗ
今回は長くなるのでここまでにしましょう。
次回も第12章の解説になりますが、また面倒くさいことが
沢山書いてあるので、そこにもツッコミを入れていく予定です。
