MPF: CircuitとCircuitry

お客様よりご質問をいただきましたので簡潔にまとめておきます。

私の考えとしては、電気回路が図面で開示されているような装置の発明の場合、どちらが良いかは気にしなくてよいと思います。審査官が112(f)を適用してきたら、Circuit/Circuitryはそれのみで構成を示す単語だとMPEPを引用して反論し、それでも考えを変えないようなら、審査官による112(f)の解釈は拒絶理由ではありませんので、主張だけを残しておけばＯＫです。

（あまりに機能的・抽象的な限定のみを伴っている場合、権利範囲上問題ない範囲で、図面に示されている電子部品なり回路構成なりを特定する限定を入れてから反論したほうが良い場合もあります）

純粋な英語の問題として捉えればCircuit, Circuitryの意味は完全に同じではありませんが、クレームの用語は、辞書などの外部証拠に拠る前に、内部証拠、すなわち明細書の文脈で解釈されるため、図面に開示された回路図もその判断の基準になると考えると、電子回路を示すこれらの用語の違いが、112(f)の適用や用語解釈に大きな影響を及ぼすとは考えにくいです。

一方、ピュアなソフトウェア発明で、Circuitといいつつも、図面には四角形のハコが図面に開示されているだけのような案件の場合、112(f)適用を免れやすくすることを期待してCircuit, Circuitryという用語を持ち出すくらいなら、以前のエントリでもご紹介したように、program codeに言及したほうが有益と考えられます。
