We emphasize that this U.S. Patent was not relied upon in the first Office action and has only applied against the present claims (including substantially unamended claims) for the first time. Under these specific facts, it is our opinion that a Petition to have the finality of the instant Office Action withdrawn would possibly be granted even though this conclusion is not free of doubt.
