[“Eighth Grade Syndrome” is a Japanese term which means “exhibiting a firm and often aggressive conviction of knowledge and wisdom and unaware of limitation and lack of maturity”]
　先日まで、学校法人「森友学園」の話題ばかり取り上げていた日本メディアが、やっと北朝鮮の核実験やミサイル開発問題を報じるようになった。だが、どこか傍観者的な印象を受ける。
　The Japanese media has finally started reporting about North Korean nuclear tests and missile development after spending all its time talking only about the “Moritomo School” issue until just the other day.

　北朝鮮は弾道ミサイルの攻撃目標に、在日米軍基地や日本の都市が含まれると公言している。同国が事実上の核兵器保有国であり、猛毒のサリンや神経剤ＶＸなど、生物化学兵器を大量保有することも周知の事実だ。安倍晋三首相は１３日の参院外交防衛委員会で、北朝鮮がサリンを弾頭につけて着弾させる技術を保有している可能性を指摘した。
　North Korea has officially said that the targets of its ballistic missiles include U.S. bases in Japan and Japanese cities. For all practical purposes, North Korea possesses nuclear weapon capability, and it is a well-known fact that it has large stocks of chemical and biological weapons such as the highly toxic sarin gas and the nerve agent VX. On the 13th Prime Minister Shinzo Abe pointed out in the upper house Foreign Relations and Defense Committee that there is a possibility that North Korea has the technology to load sarin gas into a missile and deliver it by way of a ballistic missile strike.

　朝日新聞は翌１４日の「素粒子」欄で、こう書いた。
　《シリアと同じだと言いたいか。北朝鮮がミサイルにサリンを載せられると首相。だから何が欲しい、何がしたい》
　The next day in its column “Elementary Particles,” the Asahi Newspaper wrote “Does he mean to say that this is the same as Syria when the prime minister says North Korea can load sarin gas on a missile? What does he want? What does he want to do?”

　私には「北朝鮮の悪い印象を払拭したり、日本人の『平和ボケ』を維持しようと努力しているのに、首相は余計なことを言うな」と言いたいように読めた。朝日こそ「何がしたい」と聞きたい。
　To me this column reads as if the Asahi Newspaper wanted to say, “When we are trying so hard to erase the negative image of North Korea and perpetuate the Japanese people’s complacency about peace, the prime minister needs to keep quiet.” My question is “What does the Asahi Newspaper want to do?”

　日本共産党の志位和夫委員長も２０１５年１１月、テレビ番組に出演し、「北朝鮮、中国にリアルの危険があるのではなく、実際の危険は中東・アフリカにまで自衛隊が出て行き一緒に戦争をやることだ」と述べた、と産経新聞（電子版）が報じている。
　The Sankei Newspaper reports (in its online version) that the Chairman of the Japan Communist Party Kazuo Shii appeared on TV in November 2015 and said “There is no real danger from North Korea or China. The real danger is that Japanese self-defense forces may go to the Middle East or Africa and participate in a war.”

　志位氏は１２日、ツイッターに《トランプ大統領が、米国単独で北朝鮮への軍事力行使に踏み切る可能性を示唆。破滅をもたらす軍事力行使に強く反対する。経済制裁の強化と一体に、外交交渉のなかで、北朝鮮の核・ミサイル開発の手を縛り、放棄させることが何よりも大切だ》と書いた。
　On April 12th, Mr. Shii wrote on Twitter that “President Trump has indicated there is a possibility that the U.S. will take unilateral military action against North Korea. I am strongly opposed to military actions which will bring about destruction. The most important thing is, while tightening economic sanctions, to tie the hands of North Korea’s nuclear and missile development through diplomatic negotiations to make them abandon [nuclear and missile development].

　正論のつもりかもしれないが、自分にできもしないことを他人にやれと言うのは無責任だ。まずは、ご自身の持つ交渉力で、有権者を説得して政権交代を果たし、外交交渉の当事者になったらどうか。
　He may intend this as a sound argument, but it is irresponsible for him to demand that others do what he is not able to do himself. First, he needs to learn negotiation skills, then win over the voters and effect a change in administration, and then he should be the one to do the diplomatic negotiations.

　作家の百田尚樹氏は、志位氏のツイートに対して、《北朝鮮に核を放棄させることが何より大切なら、お前がやってみろよ！　誰も出来なかったから、アメリカが軍事力で止めようとしてるんじゃないか！　黙ってろ、北朝鮮の手先が！》と反撃した。
　In response to Mr. Shii’s tweet, author Naoki Hyakuta replied “If you think the most important thing is to get North Korea to abandon nuclear arms, you should do it yourself! America is threatening to stop them through military force because no one has been able to do what you say. Just shut up already, you agent of North Korea!”

　表現は少し過激だが、気持ちは分かる。
　The words are a little bit extreme, but I understand his feelings.

　そもそも、金正恩（キム・ジョンウン）朝鮮労働党委員長は、何をやるのか予測困難だ。人間は成長とともに、感情より理性に基づいて合理的かつ冷静に行動しようと心掛けるようになる。しかし、彼はその成長過程を経ることなく、独裁者の地位に就き、感情の赴くままに部下を殺し、日米韓を理不尽に恫喝（どうかつ）している。
　In the first place, it is very difficult to predict what Korean Workers Party Chairman Kim Jong-un will do. As human beings progress, they usually learn to act rationally and dispassionately based on logic rather than emotions. But he assumed the position of dictator before completing the progression process, kills subordinates according to the dictates of his emotions, and irrationally engages in intimidation of the U.S., Japan, and Korea.

　日本テレビ系「行列のできる法律相談所」の出演者として有名な北村晴男弁護士は９日、ツイッターで以下のようにつぶやいた。
　On April 9th, Haruo Kitamura, an attorney who appears on the popular NTV variety program “Your Legal Clinic,” tweeted on Twitter as follows.

　《弁護士になりたくて頑張った。弁護士会に入らないとなれないので、入会した。多額の会費も払い続けている。すると、会や会長の名前で意見書や声明が出される。中には、共産党や社民党等の主張にそっくりで、自分の主張と真反対なものがよくある。「俺は政党に入ったんじゃ無い！」と叫びたくなる。》
　“I worked hard to become an attorney. Since I was required to do so, I joined the bar association. I have continued to pay high dues. But the bar association and its chairman send out official opinions and official statements. Some conform precisely to the policies of the Japan Communist Party and the Social Democratic Party, and they are often directly opposed to my own views. I want to shout: ‘I didn’t join a political party!’”

　このツイートは話題を呼び、短期間で１万回以上もリツイートされた。
　This tweet drew a great deal of attention, and in a short time was retweeted 10,000 times.

　私は以前から、日本弁護士連合会（日弁連）による左派偏重の政治活動を批判してきたが、日弁連への入会を義務付けられた日本の弁護士が、北村氏の主張を支持するには勇気がいるようだ。賛同意見を表明した弁護士の話をまだ聞かない。
　For some time now I have been critical of the left-wing political activities of the Japan Federation of Bar Associations (the Federation), but it seems that it requires some amount of courage for Japanese attorneys who are required to join the Federation to support the arguments of Mr. Kitamura. I still have not heard of any attorneys publicly expressing like opinions.

　私が所属するカリフォルニア州弁護士会でも、以前、強制徴収された会費を一部の左派弁護士が政治活動に使っていた。
　In the past, the California Bar Association of which I am a member used a portion of our compulsory dues to support left-wing political causes.

　左派弁護士の政治活動の自由は認めるべきだが、保守派の弁護士は彼らに資金提供したくない。サイレントマジョリティーだった私たちは、ついに声を上げ、強制徴収された会費を政治活動に使えないよう規則を変更させた。
　We should allow the freedom for left-wing attorneys to engage in political activities, but conservative attorneys need not provide financial support for those activities. In California those of us in the silent majority raised our voices, and the rules were changed such that compulsory dues could not be used for any political activities.

　日弁連のウェブサイトを見ると、会長声明・意見書等の中に「最新の意見書」というコーナーがある。「いわゆる共謀罪を創設する法案を国会に上程することに反対する意見書」（２月１７日）、「本国憲法に緊急事態条項（国家緊急権）を創設することに反対する意見書」（同）などが掲載されている。
　On the Federation’s website, among the official opinions and official statements there is a section titled “latest official opinions.” Included are an “Opinion Opposed to Consideration of a Bill to Create a So-called Anti-Conspiracy Crime” (February 17) and an “Opinion Opposed to Adding a Provision to the Constitution for Emergency Powers” (February 17).

　また、２０１６年の会長声明には、「死刑執行に強く抗議し、改めて死刑執行を停止し、２０２０年までに死刑制度の廃止を目指すべきであることを求める会長声明」（１１月）や、「朝鮮学校に対する補助金停止に反対する会長声明」（７月）などがある。
　In addition, there are 2016 statements titled “Official Statement That We Are Strongly Opposed to Capital Punishment, That Carrying Out of Capital Punishment Should Be Stopped, and That Capital Punishment Should Be Abolished by 2020” (November) and “Official Statement in Opposition to the Abolishment of Financial Support for [North] Korean Schools” (July).

　これらの政治的問題は世論が鋭く対立している。新聞の社説なら分かるが、日弁連の意見書や会長声明に世論誘導の意図が読み取れるのは問題だと思う。
　Public opinion on these political issues is sharply divided. I can understand newspaper editorials stating such opinions, but I think the fact that the Federation undertakes to deliberately influence public opinion through official opinions and official statements is highly problematic.

　そもそも、「２０２０年までの死刑制度廃止」は、日弁連全会員約３万７０００人のうち、７８６人が採決に参加し、５４６人が賛成したに過ぎない。わずか１・５％だ。３万６０００人超の弁護士は、不在投票も委任状の提出もできなかったという。
　For starters, the statement about “Abolishment of Capital Punishment by 2020” was adopted by a vote including only 786 of the 37,000 members of the Federation in which only 546 voted in favor. This is just 1.5% of the total membership. The remaining more than 36,000 attorneys were not permitted to submit absentee ballots or vote by proxy.

　日弁連は、それを「日弁連意見書」や「日弁連会長声明」などの名称で発表する。この事実を、弁護士の多数意見と勘違いした人が知れば、「詐欺同然」と言いたくなるのではないか。
　The federation issues these under the title of “Opinion of the Japanese Federation of Bar Associations” or “Official Statement of the Japanese Federation of Bar Associations.” If people who mistakenly believed these to be the opinions of the majority of attorneys were to know the facts, no doubt they would consider it “tantamount to fraud.”

　執行部の暴走を黙認してきた弁護士にも道義的責任がある。弁護士業が多忙なのは分かるが、自分が所属する組織内の正義も追及してほしい。
　The attorneys who tacitly permit this recklessness bear some moral responsibility. I understand that attorneys are busy, but they should demand proper accountability of the organization to which they belong.

　温厚な日本人と比較すれば、米国人である私は、接客の内容や態度などに対して、クレームを言うことに躊躇（ちゅうちょ）がない。
　As compared with the mild-mannered Japanese, as an American, I don’t hesitate much to make claims about customer service and the attitude of those providing the customer service.
 

　先日も某銀行の窓口で、海外送金の書類を出した後、何の経過報告もなく１時間以上も待たされたので、強いクレームを入れた。１９９０年代には、航空会社の要注意客ブラックリストの上位に私の名前があると週刊誌で報じられた。幸か不幸か、「有名人だから遠慮する」という思考パターンが、私の脳内には存在しない。
　The other day at a certain bank, after I submitted the papers for an international funds transfer, I was left waiting for more than one hour without any explanation of the delay, and I lodged a strong claim. In the 1990’s, it was reported in a weekly magazine that I had been placed near the top of the passenger blacklist by a Japanese domestic airline. [This was mainly because I complained endlessly and loudly about the lack of no-smoking seats, or the fact that smoking was even allowed on the airliners.] For good or bad, the thought pattern that “I should defer because I am somewhat famous” does not exist in my brain.
 

　最近は、私の言論内容を敵視する人も増えており、「ケントはただのクレーマー」などと、ツイッターなどで喜んで騒ぐ人が出そうである。しかし、私は今後も機会があればクレームを言い続けるだろう。
　Lately, a few people hostile to my opinions have had fun on Twitter saying that “Kent is just a ‘claimer’ [disparaging term for ‘claimant’].” However, I will probably continue to lodge claims as occasions arise.
 

　クレームを契機にサービスの改善が図られれば、結果的に相手も得をする。引いては社会全体の利益にもつながる。いわゆる、「ウィン・ウィン」を目指すからこそ、私は人目も気にせずクレームを言う。
　If improved service is spurred by a claim, the other person also benefits. And that benefits the entire company. Precisely because I am motivated by this “win-win” scenario, I can state claims without being self-conscious.
 

　一方で、世の中には絶対に受け入れてはならないクレームが存在する。クレーマーだけが得をして、受け入れた側が一方的に損をする「ウィン・ルーズ」のクレームである。
　On the other hand, there are certain claims [or demands] in the world which should never be accepted. Those are “win-lose” situations where only the claimant wins and the other person one-sidedly loses.
 

　それぞれが受けた損失は小さくとも、理不尽なクレームに屈した事実が社会正義をゆがめ、積み重なると国益を害する。日韓関係と日中関係は、その典型例である。
　Even if the loss is small, the fact that one knuckled under to an unreasonable claim warps social justice, and when such incidents accumulate they result in a harm to national interests. Japanese-Korean relations and Japanese-Chinese relations are typical examples.
 

　終戦後、日本人に「ウィン・ルーズ」の理不尽な要求を突きつけた史上最大のクレーマーは、マッカーサー元帥率いるＧＨＱ（連合国軍総司令部）だった。当時の日本メディアは、ＧＨＱという最強クレーマーに屈するしか生き残る手段がなかった。
　The biggest “claimer” in history was GHQ (General Headquarters of the Supreme Allied Commander) which made outrageously unreasonable “win-lose” demands of the Japanese people. The Japanese media had no means of surviving without knuckling under to this most powerful claimant.
 

　占領終了後も、クレーマーに弱い日本メディアの体質は変わらなかった。ＧＨＱが去ると、占領政策が育てた左翼政党や労組、民族団体などが、隙間に入り込んだ。こうして組織的なクレームでメディアを裏から動かし、世論や行政をコントロールしようとする団体がいくつか生まれた。
　After the end of the occupation, this basic weakness of the media in the face of claims did not change. Upon the departure of GHQ, left-wing political parties, unions, and ethnic organizations nurtured by the occupation policies rushed in to fill the void. A number of organizations sprang up that tried to manipulate the media behind the scenes and to control public opinion and the administration with organizational claims.
 

　東京ＭＸテレビ「ニュース女子」の沖縄報道は、日本メディアがクレームを恐れて意図的に隠してきた事実を暴露する内容だった。「忖度（そんたく）」が得意な、左派新聞はろくに調査することなく「事実と異なる報道」などと無責任に報じ、復讐（ふくしゅう）劇を演じた。
　The report aired [in January] on Tokyo MX TV’s “News Girls” about Okinawa exposed facts theretofore deliberately hidden by the media because of its fear of claims. Leftist newspapers who specialize in “baseless conjecture,” without making any appreciable effort to investigate the facts, irresponsibly reported that the program was a “false program” in a show of revenge.
 

　クレーマーに屈する情けないメディアと、その子会社のようなＢＰＯ（放送倫理・番組向上機構）は、「忖度しないメディア」に対するクレーマーそのものに落ちぶれたのではないか。
　The pitiful Japanese media which buckles under to claimers, along with its subsidiary the BPO (Broadcasting Ethics & Program Improvement Organization), have been reduced to being claimers against “media which does not engage in baseless conjecture.”
 

　かつて、「総会屋」に利益供与を行う上場企業をさんざん批判してきたメディアは、そろそろクレーマー対策を本格的に行うべきではないのか。
The media, which has relentlessly criticized listed companies for bowing to pressure to pay off “sokaiya” [racketeers who extort money from companies by threatening to cause trouble at the general meeting of the stockholders], now needs to get serious about implementing its own claimer policy.
