自由民主主義社会の道徳を自由民主主義の原理の枠組みを定めている国際人権条約（国際法）に照らすとどうなるか？について、下記考察しました。
記
憲法前文1項
日本国民は、正当に選挙された国会における代表者を通じて行動し、われらとわれらの子孫のために、諸国民との協和による成果と、わが国全土にわたつて自由のもたらす恵沢を確保し、（政府の行為によつて再び戦争の惨禍が起ることのないやうにすることを決意し、＝戦争責任を我が国に負わせる占領軍政用条文である。国民の厳粛な信託の下に国政を行うとしているのであるから、我が国の主権回復後は無用であり無効）ここに主権が国民に存することを宣言し、この憲法を確定する。そもそも国政は、国民の厳粛な信託によるものであつて、その権威は国民に由来し、その権力は国民の代表者がこれを行使し、その福利は国民がこれを享受する。これは人類普遍の原理であり、この憲法は、かかる原理に基くものである。われらは、これに反する一切の憲法、法令及び詔勅を排除する。（自由民主主義の原理に基づく政治を国是として定め、他の法律を一切排除すると立憲している。）
国際人権条約前文 The States Parties to the present Covenant,
Considering that, in accordance with the principles proclaimed in the Charter of the United Nations, recognition of the inherent dignity and of the equal
and inalienable rights of all members of the human family(=individuals) is the foundation of freedom, justice and peace in the world,（＝これの主語となるものが基本的人権の内容、家族や共同体の人々が形成した尊い習俗と人間愛から成るもの）
Recognizing that these rights derive from the inherent dignity of the human person,
Recognizing that, in accordance with the Universal Declaration of Human Rights, the ideal of free human beings enjoying freedom from fear and want can only be achieved if conditions are created whereby(=個人の自由と権利は創
設された条件であり、天賦のものではない。) everyone(=individual) may enjoy
his economic, social and cultural rights, as well as his civil and political
rights,
Considering the obligation of States under the Charter of the United
Nations to promote universal respect for, and observance of, human rights and freedoms,
＜Realizing that the individual, having duties to other individuals and to the community to which he belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the present
Covenant,（＝基本的人権のこと）＞ Agree upon the following articles:
上記赤字の規定が、自由民主主義社会において全ての個人が遵守すべき義務であり、道徳（公徳）であり、国際規範であります。これが法律化されて、個人が法律の下に奉仕する公務員或いは軍人となった場合に、憲法第11条の下に国民の基本的人権を永久に保障する義務を負い、安全保障体制が完成すると思います。
なお憲法9条は宣言文であり憲法の保障文ではないので、国会決議により解釈の変更は可能と考えます。
