中学校学習指導要領案 第１章総則 第１教育課程編成の一般方針 2 後段部分「道徳の目標」は下記のごとく変更することを提案します。確立された国際法規である自由権規約、社会権規約の前文や第５条に書かれていることは、日本国が遵守すべき重要な国際法秩序であるとともに、グローバル時代に生き且つ国際社会において名誉ある地位を望む日本人の素養、道徳でなければならないと思います。両規約の法秩序を道徳に引き直して書き改めてみました。

道徳教育を進めるに当たっては、憲法の規定に従い国民は自由民主主義国家の構成員として、「家族や共同体の人々が永年培ってきた固有の尊厳である習俗、多神教の習俗、天皇制、先祖崇拝、伝統、文化、道徳、法律、領土、領海、郷土、生命、財産、並びに、慈愛の心を表す基本的人権」に対し、畏敬の念を持ち豊かにして最も大切にする心の育成に資するよう特に留意して行われなければならない。「生まれながらに自由と権利を有する個人や私人」は、常に家族や共同体の人々に尽くす義務があるだけでなく、その自由と権利を確かに享受するために創設された言論の自由等の個人の自由と権利と共に、常に基本的人権を増進、擁護する義務があり、これを侵して社会秩序、法秩序を乱すようなことがあってはならない。同時に他国民の基本的人権を侵さないよう十分留意しなくてはならない。以上以下ご参考までに両規約の前文のみ付記します。
＜ The States Parties to the present Covenant,
Considering that, in accordance with the principles proclaimed in the Charter of the United Nations, recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,
Recognizing that these rights derive from the inherent dignity of the human person,
Recognizing that, in accordance with the Universal Declaration of Human Rights, the ideal of free human beings enjoying freedom from fear and want can only be achieved if conditions are created whereby everyone may enjoy his economic, social and cultural rights, as well as his civil and political rights,
Considering the obligation of States under the Charter of the United Nations to promote universal respect for, and observance of, human rights and freedoms,
Realizing that the individual, having duties to other individuals and to the community to which he belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the present Covenant,
Agree upon the following articles:＞
