パナマの法律事務所「モサック・フォンセカ」から流出した、いわゆる「パナマ文書」が話題だ。タックスヘイブン（租税回避地）を利用する世界各国の指導者、政治家、企業、個人などのリストは、表現の自由がある国ならば誰でもネット上で見られる。
The so-called “Panama Papers” which were leaked from the law firm “Mossack Fonseca” are a hot topic. A list of leaders, politicians, companies, and individuals from around the world that used tax havens can be viewed at will by anyone in a country which still has freedom of the press.
租税回避は昔からある話だが、近年のアップル、アマゾン、グーグルに代表される巨大グローバル企業や、超富裕層の積極的な節税は行き過ぎだと思う。だが、合法である限り、原則として倫理的責任しか問えない。
Tax avoidance is an old topic, but I think that in recent years global giants such as Apple, Amazon, and Google, as well as the super-rich have gone too far with active tax avoidance. However, since it is no illegal, generally only ethics and morals are in question.
一方で、国の指導者や政治家、官僚などは話が別である。彼らは、国民の血税を原資とした報酬を受け取る立場だからだ。租税回避は、国家の徴税権を自ら脅かす大問題であり、賄賂など不正の温床にもなる。
On the other hand, leaders of countries, politicians, and bureaucrats are another matter. That is because their source of income is taxes on the hard-earned income of the people. Their tax avoidance is a personal threat to the sovereign authority to levy taxes, and provides a hotbed for bribes and other corruption.

Iceland’s Prime Minister Gunnlaugsson resigned immediately after his involvement was disclosed. Analysis of the vast volume of 2.6 terabytes of data has not been completed yet, but as of now, while the names of a number of famous companies appear, no names of powerful U.S. or Japanese politicians appear.
The names of Great Britain Prime Minister Blair’s deceased father, friends of Russian President Putin, the brother-in-law of People’s Republic of China (PRC) President Xi Jinping, and former presidents and prime ministers of South American and Middle East countries are said to be on the list.
A large number of high officials of the Chinese Communist Party appear to be clients of this law firm. Spiriting of ill-gotten gains from the PRC paradise of corruption to foreign jurisdictions by these officials is in preparation for the expected demise of their own country.
Mossack Fonseca maintains that the Panama Papers do not prove any improprieties, and that there is nothing illegal about their business of setting up offshore companies. Rather, the law firm claims to be a victim of leaked information. That is not untrue.
However, it has been reported that Rami Mafurufu, the cousin of Syrian President Assad who amassed a fortune of 5 billion dollars through corruption and who was the proximate cause of the Syrian uprising in 2011, was a client of this law firm. This has also created a hotbed for illegal drug transactions, weapons trade, and dealing in stolen goods. It is shameless for this law firm to claim to be purely a victim.
With their deep knowledge of the law, judges, prosecutors, and attorneys have a duty to implement social justice and propriety. On the other hand, they also have many chances to see the other side of society, and some slip into the dark side by accepting any work for money by fair means or foul. Intellectual criminal offenders that prey on society like termites are a truly bad lot.
As a person with carrying the title “California Attorney,” I truly regret the decline in ethical consciousness and morals among current and former members of the legal community throughout the world.
