性犯罪者対策　What to Do with Pedophiles?

９月３日号の週刊新潮の目次によると、寝屋川の中学1年生２名を殺害した山田浩二容疑者は、小児性愛者として性犯罪者リストに載る、前科８犯の人間だったようです。この性犯罪者リストは非公開になっています。
According to the September 3 issue of Shukan Shincho, Koji Yamada, suspected of killing two seventh graders in Neyagawa City, was a pedophile listed with a picture on the list of sex offenders, and had at least 8 previous offenses. This list of sex offenders is not open to the public.

アメリカでは2005年以来、元性犯罪者は、ＧＰＳ装置を数年または一生涯にわたって、常時、体に装着することを義務付ける法律が、複数制定されました。学校等や被害者に近づかないこと、あるいは治療を受けること、または外出禁止時間を守ることを義務付ける場合もあります。
Since 2005, in the U.S. many laws have been passed requiring former sex offenders to wear a GPS device on their body at all times for many years or for life. They may be restricted from going near schools, required to attend treatment, obey a curfew, or stay away from former victims.

カリフォルニア州で行われた研究の結果、ＧＰＳを装着する人と比べて、装着義務のない元性犯罪者の性犯罪再犯率は、３倍も高いという結論が報告されました。
A study in California reported that compared with people wearing a GPS device, the recidivism rate for former sex offenders who were not required to wear the device was three times greater.

1994年から複数の州では、元性犯罪者が出所した後に、名前と住所を州に登録しなければならない法律を制定しました。州がそのデーターベースを管理します。場合によっては、元性犯罪者が引っ越す場合は、引っ越し先の住民に通知されます。
Beginning in 1994, several states passed laws requiring former sex offenders to register their names and addresses with the state. The state then maintains a database. Residents of a neighborhood to which the former offender moves may be notified.

連邦政府は、「全国性犯罪者公認ウェブサイト」を管理していて、誰でもそれを検索することができます。試しに、Alfonso Rodriguezという名前で検索してみてください。
The federal government provides a national sex offender public website which can be searched by anyone.

米国では、ほとんどの専門家は、小児性愛者を更生させることは不可能だという見解です。小児性愛者の脳内回路を変えることはできません。
In the United States, it is the view of almost all experts that a pedophile cannot be rehabilitated. A pedophile cannot change the way his brain is wired.

カウンセリングや治療は効果がないので、性犯罪の再発を防ぐ唯一の方法は、元犯罪者がその性癖に基づいて行動しないように、常に監視下に置くことです。そのためには、元性犯罪者の個人情報を公開する必要があります。
Since counseling and treatment are not effective, the only way to prevent recurrence of sexual offenses is by constant monitoring of the former offender to prevent him from acting on his proclivities. It is therefore necessary to make information on former sex offenders available to the public.

性犯罪者の人権侵害だと主張する人はいますが、性犯罪者のプライバシーと子供たちの安全を天秤にかければ、安全な社会を確保するためにやむを得ないでしょう。
There are some who say this is an infringement on the human rights of the sex offenders, but when the privacy of sex offenders is weighed against the safety of children, this seems to be a necessary measure to maintain a safe society.

日本でも、アメリカと同じような体制を作ればいいと思います。
I think a system similar to that of the United States should be implemented in Japan.

性犯罪者の情報公開については、日弁連が大反対しています。彼らは犯罪者の人権ばかり優先し、罪のない一般人の人権を考慮していません。「性犯罪者を野放しにすることが望みなのか？」と邪推したくなります。

The Japan Federation of Bar Associations is adamantly opposed to having information about sex offenders made public. They are putting the rights of sex offenders first above consideration of the human rights of innocent members of the public. It makes me wonder if it is really their desire to have criminal sex offenders turned loose without any supervision.
