ご存知の方々 が おいでに なると 思いますが
"AMBER Alert"(アンバーアラート) という警報ｼｽﾃﾑ
があります。
"America's Missing：Broadcast Emergency Response" の略と
1996年にﾃｷｻｽ州ｱｰﾘﾝﾄﾝで誘拐・殺害された少女
"Amber Hagerman " の名にちなんだﾀﾞﾌﾞﾙ･ﾈｰﾐﾝｸﾞだと
されています。
児童誘拐・行方不明事件が発生した際、ﾃﾚﾋﾞ・ﾗｼﾞｵ
・幹線道路電子掲示板などの公衆メディアを通じて
発令される緊急事態警報です。
"AMBER Alert" を発令するには 様々な条件を充足
する必要があり、未成年者の行方不明が発生した
場合に "即刻" 警報を発令するように修正したのが
"Skylar's Law" です。
この "Skylar's Law" 制定のキッカケとなった事件を
ちょっと覗いてみることにいたしましょう。
「16歳の Skylar Neese が ｳｴｽﾄ･ｳﾞｧｰｼﾞﾆｱのｽﾀｰ・
ｼﾃｲｰの家から 2012年7月6日真夜中頃に行方不明
となった。
2013年1月16日、ﾍﾟﾝｼﾙｳﾞｱﾆｱのｳｴｲﾝ･ﾀｳﾝｼｯﾌﾟで
Skylar の遺体が発見された。
2013年5月1日、十代の Rachel Shoaf が もうひとり
の十代 Sheila Eddy と一緒になって Skylar を殺す
ことを計画し実行した罪で第二級殺人有罪となった。
この Skylar 行方不明事件が 児童行方不明緊急警報
であるAMBER Aert に修正を加えた ｳｴｽﾄ･ｳﾞｧｰｼﾞﾆｱ
の新法制定のキッカケとなったのである。」
(Sixteen-year-old Skylar Neese disappeared from her home
in Star City, West Virginia around midnight on July 6, 2012.
Neese's remains were found on January 16, 2013 in Wayne
Township, Pennsylvania. On May 1, 2013, teenager
Rachel Shoaf pleaded guilty to second-degree murder,
telling authorities that she and another teenager,
Shelia Eddy, planned and carried out Neese's murder.
Neese's disappearance led to new West Virginia legislation
that made changes to the Amber Alert missing child
alert system.)
「2013年5月1日、Rachel Shoaf が第二級殺人で有罪
となったのだが、裁判記録の謄本 に よると、彼女 と
Sheila Eddy が Skylar を Eddy の車に乗せ、三人は
ﾍﾟﾝｼﾙｳﾞｧﾆｱまで行き、車を降りて 話し合いを始めた
が、予め決めていた時間に Shoaf と Eddy が 一、二
の三で Skylar を刺し殺した、と Shoaf が述べている。
Eddy と わたしは もう Skylar とは付き合いたくない、
と思ったから殺した、と Shoaf が 後日 語っている。
Shoaf と Eddy は Skylar の死体を埋めようとしたの
だが、できずに 枯れ枝で隠した。
裁判記録の謄本には 学友たちは Shoaf と Eddy が
殺人の計画について話し合っているのを耳にはしたが
冗談だと思い その事を誰にも話さなかった、とある。」
(On May 1, 2013, Rachel Shoaf pleaded guilty to second
degree murder. According to the court transcript, Shoaf
said that she and Shelia Eddy picked up Neese in Eddy's
car. The girls drove to Pennsylvania, got out of the car,
and began socializing. At a pre-arranged time, Shoaf
and Eddy stabbed Skylar to death on the count of three.
Shoaf later admitted that they killed Skylar because
"They didn't want to be friends with her anymore".
The teens attempted to bury Neese's body, but were
unable to do so and instead covered the body with
branches. The court transcript indicates that other
students overheard conversations between Shoaf and
Eddy about the murder plot, but failed to report it,
thinking they were joking.)
「Shoaf に対する訴状によれば、"法に背き、犯意を
持ち、自らの意図で、害意を持って 故意に 刺して
致命傷を負わせて Skylar Neese を死に至らしめた"
ことにより 第二級殺人で有罪とする、とされている。
そして、ｳｴｽﾄ･ｳﾞｧｰｼﾞﾆｱ州は 20年の拘禁刑が相当
であろうと 訴状で 意見を述べている。
Shoaf の家族は 弁護士を通じて謝罪の気持ちを公表
している。」
(According to Shoaf's plea agreement, she pleaded
guilty to murder in the second degree by "unlawfully,
feloniously, willfully, maliciously and intentionally causing
the death of Skylar Neese by stabbing her and causing
fatal injuries". In the plea agreement, the State
of West Virginia will recommend a sentence of twenty
years incarceration. Shoaf's family issued a public
apology for her actions through their lawyer.)
「2013年9月4日、ｳｴｽﾄｳﾞｧｰｼﾞﾆｱ州の検察は Sheila
Eddy を Skylar Neese 殺害で Shoaf に続く二人目の
実行犯として起訴すること 及び 彼女 を 成人として
裁判することを公表した。
Eddy は 2013年9月6日、大陪審により 誘拐罪、第一
級殺人罪及び殺人を計画した罪で起訴された。
Sheila Eddy は これらを全面否認した。
裁判は 当初 2014年1月28日に予定されていたのだが、
その4日前の 1月24日に Sheila Eddy は 全面否認を
撤回し、死刑を回避する減刑条件付きで 第一級殺人罪
を認める旨を決めた。
その結果、Eddy は 終身刑に処せられた。
15年の拘禁刑服役後に 保釈申請可能となっている。」
(On September 4, 2013, West Virginia prosecutors publicly
identified Shelia Eddy as the second alleged perpetrator
of the murder of Skylar Neese and announced that she
will be tried as an adult. Eddy was indicted by a grand
jury on September 6, 2013 with one count of kidnapping,
one count of first-degree murder, and one count of
conspiracy to commit murder. Shelia Eddy pleaded not
guilty to these charges. The date of the trial was originally
set for January 28, 2014, but on January 24 - four
days prior to the trial - Shelia Eddy changed her former
"Not Guilty" plea and decided to plead "Guilty" to first
degree murder with mercy. As a result, Eddy was
sentenced to life imprisonment, with parole eligibility
after she has served 15 years. )
