GM Chapter 11申請
GMがChapter11の適用申請をしましたね。
去年の夏にREGを受験して以来なのですっかり忘れてました。
合格しても実務に使わなければ、ただの自己満足ですよね…。
そんな反省も兼ねて、当時のメモを引っ張り出してみました
Chapter 11 Reorganization
・債務者の事業存続を目的として再構築を行う手続き
⇒ NO liquidation occurs
・会社、パートナーシップに加え、個人も利用可能
・Debtor-in-possession (占有継続債務者)が認められている
・ Generally, a trustee (破産管財人) is NOT appointed
・VoluntaryもInvoluntaryも可 (Chap7と同じ要件)
・Confirmation of the reorganization plan occurs by approval or cram down
a) Reorganization plan is essentially a contract between the debtor and its creditors
一般債務は最長3年、税金債務は最長6年の延長ができる
b) Approval
1) Creditors holding 2/3 in amount and 1/2 in number of each class of claims
2) Stockholders holding at least 2/3 in amount of the stock
c) Cram down
Court forces all creditors to approve the plan that has been approved by only one class of claims
d) Confirmed plan binds all creditors and stockholders
e) Confirmaton terminates the automatic stay
・Once the plan is confirmed by the court, the debtor is discharged from all debts that arose before the confirmation except otherwise provided for in the plan

今更ですが、Wave2のRelease予定日です。（Another71より）
5月7日に試験を受けてから、脳みそはずっと放電中
TIP SIE ACDO・・・もはや懐かしい記憶となってますね。

- BEC - Monday, June 15
- REG - Wednesday, June 17
- AUD - Thursday, June 18
- FAR - Saturday, June 20
ボーナス無し…
夏のボーナス大幅減！！
ってニュースを他人事のように聞いていたら
自分の身にも降りかかってきました
去年までは、ほぼ固定給だったのですが
今年からは四半期ごとの部門業績に連動するよう変更されたのです。
そして、金融危機やらで部門の業績はガタ落ちして
結果、第一四半期のボーナスはほぼゼロになりそうです。
利益を株主に還元する前に、従業員にボーナス払えっつうの
あぁー、ドラム式の洗濯機が欲しかったのに…
