もう一度読んでみたけど、普通によくあるコラムでした。韓国内で広がっている噂話を、日本語にして日本人向けに書いたもの。でも今回の起訴のお陰で、全世界がこの噂話を知ることになりますね。率直な感想を言えば「君たち、またやっちゃったの！」ですね。
I read this article again. (The above URL contains an article in the Sankei Newspaper. It is only available in Japanese, but it summarizes the rumors circulating in the Korean media as to the whereabouts of Korean President Park during seven hours during the day when the passenger ship Sewol was sinking, taking the lives of 304 passengers. It intimates that the unmarried President Park was with a male lover based on various Korean media reports. In response to this article, Korea banned the Sankei Newspaper Seoul Bureau Chief from leaving Korea. He was later replaced as bureau chief by Sankei Newspaper, but Korea has finally brought criminal charges against him personally.) It seems to me to be a sort of run of the mill article. It was written in Japanese for a Japanese audience as a report of the rumors being discussed in the Korean media. However, by bringing criminal charges, the rumors have been brought to the attention of the whole world. My frank reaction is “You guys have shot yourselves in the foot again.”
いいんですよ、別に。元支局長を起訴しない限り、大統領個人や、国家の名誉が傷付けられると判断したわけですよね。恐らく、２カ月以上にわたって散々考えた挙句、やっと下した最終決断なんですよね。まあ、それだけ時間を掛けた分、あなた方の決断の根拠が「直感！」とか「フィーリング！」とか「カン！」ではないことは伝わりました。たぶん正解は「ハン！」だと思うけどね。

ここで突然、今日の本題とは全く関係のない芸能界の話に脱線しちゃいます。理由は聞かないで下さい。クイズ番組で時々、もの凄く早いタイミングでボタンを押して、無茶苦茶な答えを出すタレントさんがいますよね。呆れた司会者が「その答えの根拠は？」ときくと「カン！」と言っちゃったり、まったく支離滅裂な独自の論理を展開したりする人のことです。
At this point I am going to off subject and talk about the entertainment industry. Don’t ask why. Sometimes in quiz shows celebrity talents will push the answer button very quickly and give a nonsensical answer. When asked by the non-plussed MC the reason for his or her answer, the contestant will often reply, “It was inspiration” and give an incoherent answer based on original and humorous “logic.”
上手く行けば「天然」とか「おバカタレント」としてお茶の間にウケて、お笑い芸人でもないのに、お笑い枠のタレントとして大成功することがあります。
This works very well for comedians. In the best case scenario, viewers may give a very positive response to such an answer by someone who is not actually a comedian but manages to make his or her response fit into that category in this way.
日本の芸能界の場合、本当は賢いのに計算で「おバカさん」を演じている人も多いと思います。でも時々、「これは計算じゃないよね…」というケースも見かけます。
In the Japanese entertainment industry, there are many people who are actually very smart but play the role of the fool. But if they use this technique too often or in the wrong circumstances, viewers are left to think “this guy is not just acting a role, but is actually not as smart as we thought.”
賢いはずの知識人・文化人枠の出演者がそれをやっちゃったりすると、プロデューサーは今後、その人をどういう使えば良いのか悩みます。世間から知識人と思われている人間って、そういうリスクを背負ってるんです！ この怖さ、分かってもらえますか！？
Thus if a member of the intelligentsia or some other widely regarded cultural figure tries this technique, the producer is often left wondering how to use that person in the future. A person who is widely considered to be very intelligent takes a big risk by going down this road.
さて、私の個人的意見ですが「お笑い枠」と世間に認定された場合は、お笑い枠の流儀に徹した方が良いと思います。直感で答えようが必死に考えようが、最終的に出した答えがおかしければ、どうせ笑われます。
My personal opinion is that if a person is recognized as a comedian, this style will work well. It doesn’t matter whether he answers off the cuff or thinks carefully about his answer. So long as the answer which he eventually produces is entertaining, the audience will laugh.
名誉や体面や世間体を取り繕おうとすればするほど、ますます非常識なことを言い出して、世間にもっと笑われるのがオチです。自分では笑わせるつもりが無いのに、何をやっても笑われる･･･。もはや悲惨としか言えなクネ？
But for non-comedians, it becomes very difficult to cover for such comments, and the end result may very well be that whatever he or she says produces only laughs, no matter what the original serious intent of the comment may have been.
芸能界に関する脱線話を長々と書いちゃいましたね。今日の本題については法律家の一人として色々と書きたいことがあるのですが、また超長文になりそうなので、これくらいにしておきます。昨夜、産経新聞の電話取材を受けたのですが、以下の記事になってました。
I have spent too much time discussing the entertainment industry. Going back to the original theme, as a legal expert there are a number of things which I would like to say about this incident, but in the interest of keeping this post short, I will stop here. Last night I was interviewed by Sankei Newspaper about this incident. This is the article which they wrote based on my response.

Basically, I said that the Korean response to this was an infringement of freeedom of speech, that the failure to let the former bureau chief leave the country was a form of detainment, that this sort of behavior is typical of developing countries or dictatorships as opposed to a mature democracy, and that it was overkill. I said that it announces to the world the low developmental level of Korean democracy. I also called it childish and very embarrassing, and suggested that Sankei Newspaper should vigorously fight the indictment.
