The lower court pointed out that Uemura's articles were fabricated intentionally, different from the facts, and Nishioka's paper stated the truth and evidenced on the very important points. The court also stated that Nishioka's paper and The Bungei Shunjuu's article had intent of thee public interest.  Tokyo Appellate Court also supported the lower court's decision and denied Uemura’s appeal.
