今日の東京新聞に、「国家無答責論」に関する記事があった。

一言、国家無答責とは、国家無責任では、ということ。権力を持つ側は無責任なことが多いが、大日本帝国憲法下の国家無答責もその典型。
この、国家無答責、immunity from national responsibility という。
なお、国家無責任、権力の無責任と言いたい場合、irresponsibility of the authority, irresponsibility of those in power といった言い方がある。
先述の記事の中にあったコメントを紹介したい。「被害事実を認定しながら、今は存在しない法令の考え方を持ち出して訴えを退ける理屈に普遍性はないのでは」==> There is no universality in the logic to turn down an appeal for compensation by referring to the laws that do not exist now while acknowledging the damage.
