CANYON COUNTY — Wayne Leonard Canaday, one of the defendants charged in connection with the June murder of Pedro Martin Jr. in a Nampa drugstore parking lot, will proceed to jury trial Jan. 26, his attorney Kenneth Stringfield said at a court appearance Monday afternoon.

Deputy Prosecuting Attorney Justin Paskett said his office offered Canaday a sentencing recommendation of eight years in prison with two years fixed in exchange for a guilty plea. The offer will remain on the table until Thursday afternoon.
Because Canaday did not accept the offer, Paskett told 3rd District Judge Christopher S. Nye that his office would add a persistent violator enhancement to his existing charges of aggravated battery and being accessory to a felony.
Two other defendants in the case have already pleaded guilty. James Whitewater, believed to be the trigger man who shot Martin with a 9mm handgun, pleaded guilty last month to second-degree murder, aggravated battery and use of a deadly weapon in the commission of a felony. He’s scheduled to be sentenced Feb. 9 before Judge Juneal C. Kerrick.
Joshua Wasserburger, believed to have supplied the weapon used to kill Martin, pleaded guilty to a reduced charge of aiding and abetting voluntary manslaughter. He’ll be sentenced Feb. 5 before Judge Thomas J. Ryan.
According to information presented in court, in the early morning hours of July 13, police responded to reports of shots fired in the parking lot of a downtown Nampa Walgreens store. There they found a man — later identified as Martin — still alive, but with a gunshot wound to the torso and two spent 9mm shell casings on the ground. Martin died from his injuries a short time later.
Investigators suspect the incident began when Wasserburger contacted James Whitewater to help him deal with someone he referred to as “Pete” or “Pokie,” believed to be Martin, whom they believed had earlier broken the jaw of a female acquaintance and was threatening her once again.
James Whitewater and Natalie Whitewater, along with co-defendants Canaday and Alison Yancey, went to the woman’s home, investigators believe, where they found both their acquaintance and Martin. James Whitewater asked the woman if she wanted Martin to leave, according to Natalie Whitewater’s courtroom testimony, and when James Whitewater relayed her request to Martin, the confrontation turned violent.
Martin fled after James Whitewater and Canaday beat him for about 10 seconseconds, Natalie Whitewater testified at a preliminary hearing.
