特許を出す際に最も重要な特許調査の極意をお伝えします。
以前、特許調査のセミナーを行ったときのことです。
受講生から、特許調査は大変なのではないか？と質問を受けました。
例えば「検索式で抽出された特許公報1000件を読んでください」
そう言われたら、だれでも骨が折れることでしょう。
わたしは特許調査の仕事を「楽しんで」やっています。
単に特許審査官時代の経験・慣れがあるからだけではありません。
わたしの特許調査のやり方は、通常とは少し異なるのかも知れません。
特に、特許出願前の調査です（先行特許調査・先行技術調査）。
どのような先行特許があるのかを調べる調査です。
特許の出願書類を作成する弁理士としての特許調査でもあります。
以下のように、パズルのように特許調査を楽しんでできるのです。
■特許調査と、特許請求の範囲の作成を、繰り返す
細かいノウハウはさておき、弊所の特許調査の大枠は以下の通りです。
＜参考＞特許出願前に行う先行特許調査（先行技術調査）
特許出願を希望されるお客様の発明を「調査対象発明」とします。
この調査対象発明に「最も近い発明（特許公報）」を見つけます。
①「最も近い発明」がありそうなところを中心に、調査を進めます。
②調査対象発明に比較的近い発明が見つかります。
それとの比較で、どういう特許出願をすれば特許が取れるか考えます。
（＝どういう特許請求の範囲の請求項を作成すればいいか）
③今度は調査の方向性を少し変えます。
②で作成された特許請求の範囲を調査対象発明として調査を進めます。
つまり、調査の結果と、特許請求の範囲の作成とを、繰り返します。
交互にフィードバックすると言ってもいいでしょう。
この③は、まさにパズルのようです。頭の中でパズルを楽しむのです。
必要に応じてお客さまに途中経過を報告します。
④繰り返すと、調査結果として最も適切なものに集約されていきます。
一般に調査をどの時点で終了するか見極めるのは難しいものです。
弊所の場合、たしかに、審査官時代の経験も生かせます。
加えて弁理士の知見を生かしつつ、調査の終了を見極めます。
このようにして、結論にたどり着きます。
■特許調査の効果
以上のような特許調査の結果、
✔どのような先行特許が存在するか？
✔どのような内容なら特許が取りやすいか？
などを判断することができます。
仮に現在の調査対象発明では、まったく特許になる見込みがない場合
→どのような改良を行えば特許になりやすいかをアドバイスできます。
さらに、特許調査後に、特許の出願書類を作成するとき
→先行特許との違いを生かす形で、特許の出願書類を作成できます。
→特許の出願書類の作成は、特許調査と同様に楽しいものです！
■仕事の本当の楽しさとは？
上記でパズルのように楽しいと書きました。
本当に楽しいと感じるのは、
「この仕事でお客様の役に立っている」
そんな実感があるからです。
今後もお客様と楽しみながらビジネスを進めていきたいと思います。

A student asked me if patent research was difficult.

It is also a patent research as a patent attorney who prepares patent application documents.
As shown below, patent research can be enjoyed like a puzzle.
■Repeat patent research and preparation of patent claims
Leaving aside the detailed know-how, the outline of our patent research is as follows.
<Reference> Prior patent search (prior art search) before filing a patent application
The invention of the client who wishes to file a patent application is the "invention to be searched."
Find the "closest invention (patent publication)" to this invention to be searched.
① Conduct the search focusing on where the "closest invention" is likely to be.
② Find an invention that is relatively close to the invention to be searched.
Compare it with this invention and think about what kind of patent application you should file to obtain a patent.
(= What kind of claims should be created?)
③ Now change the direction of the search a little.
Proceed with the search using the scope of the patent claims created in ② as the invention to be searched.
In other words, repeat the search results and the creation of the scope of the patent claims.
You can say that you give feedback alternately.
This ③ is just like a puzzle. Enjoy solving the puzzle in your head.
Report the progress to the client as necessary.
④ By repeating this, the most appropriate search results will be summarized.
It is generally difficult to determine when to end the search.
In our case, we can certainly make use of our experience as examiners.
In addition, we use the knowledge of patent attorneys to determine when the investigation should end.
In this way, we reach a conclusion.
■Effects of patent investigation
As a result of the above patent investigation,
✔What kind of prior patents exist?
✔What kind of content is likely to be patented?
We can determine such things.
If the current invention under investigation has no chance of being patented at all,
we can advise you on what kind of improvements will make it more likely to be patented.
Furthermore, when you prepare the patent application documents after the patent investigation,
you can prepare the patent application documents in a way that makes use of the differences with the prior patents.
→Preparing patent application documents is just as fun as patent investigation!
■What is the true enjoyment of work?
I wrote above that it is as fun as a puzzle.
The reason I feel it is truly enjoyable is because I have the real feeling that
"this work is useful to customers."
I would like to continue to enjoy doing business with customers in the future.
