●発明の効果と、特許性について
特許というと、ものすごい効果がある発明！
そんなイメージがあるかも知れません。
もちろん、大きな効果がある発明は、それはそれで重要です。
ただ一般論としては、そこまで求められるものではありません。
つまり、特許になるためには、
✔発明の効果が「大きい」ことは必ずしも必要ありません。
✔発明の効果が「存在する」ことが必要です。
そして、よく考えればわかるのですが、
✔どんな発明も、なんらかの効果が存在します。
ある意味「なんとでも言える」わけです。
ですので、結論としては、
✔特許になるためには「発明の効果」はそれほど重要ではない
そういうことになります。
●重要なのは、発明の「効果」ではなく、「構成」の違い
では、重要なのはなんでしょうか？
重要なのは、従来の発明（先行特許）に対する「構成の違い」です。
「構成の違い」に関しては、違いが「大きい」ことが必要です。
この構成の違いが大きいことを、発明の進歩性と言います。
特許の世界で最も難しい判断の一つです。
「構成」が異なれば、それに起因して必ず「効果」も言えるはずです。
つまり、
構成が異なる → 効果も異なる（存在する） → 特許になる
ということになります。
●発明の効果は、なんとでも言える？
発明の効果は「なんとでも言える」と書きました。
これは、少し言い過ぎかも知れませんので、以下、補足します。
世の中のどんな出来事も、見方しだいで、必ずプラスの面があります。
一見、マイナスとも思える出来事にもです。
例えば「けがをして入院した」という出来事を考えます。
ふつうはマイナスの出来事でしょう。
見方しだいで、プラスの出来事と考えることもできます！
例えば、
✔けがをしないよう気を付けるようになった
✔入院するという経験が得られたなど
（ちなみにこれは、わたしが骨折して入院したときの実体験です。）
つまり、マイナスの出来事と、プラスの出来事は、表裏一体なのです。
特許の発明の効果も同じです。
あなたの発明に、従来の発明と比べてマイナスの点があったとします。
それでも、見方を変えれば、発明の効果になるはずです。
９９％マイナスであっても、１％プラスであれば、特許になるのです。
たしかに、９９％マイナスだけを主張したら、審査官も特許しづらい！
その点は気を付けてください。
１％プラスの方だけを、発明の効果として主張すればいいのです。
●人生のどんなマイナスとも思える出来事も、プラスの面があるはず
いかがでしたでしょうか。
どんな出来事も、必ずプラスの面があるというのは、人生も同じです。
「死ぬこと以外はかすり傷」という名言があります。
いろいろ挑戦してみて、失敗してもいいじゃないか！
そんな意味でしょう。
