特許出願人が個人の場合、法人に比べて特許率が低いと言われます。

（１）発明の高度性
個人の発明は、技術的な高度性が低いからではないか？
そういう説があります。
しかし、この点は個人の特許率が低い理由としては弱いと思います。
たしかに単なる思い付きの発明では特許は取れないかも知れません。
しかし、特許とは必ずしも技術的な高度性は必要とされません。
また、法人の特許であっても、個人と変わらないものもあるでしょう。

（２）特許の出願書類の書き方（弁理士を使うかどうか）
特許の出願書類の書き方の違いは大きいと思います。
発明を適切に表現できていないと、特許は取れません。
この点は、法人のほうが、圧倒的に有利です。
特に知的財産権部があり、特許事務所（弁理士）を使える法人です。
ただ、近年では、必ずしも大きな要因とは言えないかも知れません。
審査官が特許の方向性を適切に指摘してくれることもあります。
「特許率」という点からは、個人と法人の差は縮まりつつあります。

なお、個人の特許率を上げるためには、特許事務所に依頼しましょう。
やはり特許出願書類の作成は個人の方には限界があります。

（３）特許調査の充実度
最も大きな要因はこの点だと思います。（２）とも関係します。
あなたの発明品を、市場で見たことがないとします。
それでも、特許としてはすでに出されている可能性はあります。
この点、特許を出す前に、特許調査を行いましょう。
ただ簡易な特許調査では、先行特許を見つけられないこともあります。
十分に特許調査を行わないと、特許を取ることは難しくなります。
どんなに適切に特許出願書類を作成していたとしてもです。
この点、大手の法人には、圧倒的な優位性があります。
知的財産権部があり、専門の特許調査部門を有しています。
個人の方には、この点はなかなか難しいものです。
