フィリピンには、現在「離婚制度」はありません。
日本のように別れたいといっても
離婚届を出したら成立するといったことはありません
フィリピン人が離婚をするためには
裁判所に「婚姻無効」の申し立てをし
これを認める裁判所の判決が必要なのです。
これは「婚姻関係無効」「婚姻関係取り消し」と言う事で
婚姻していた事実を抹消する手続きになります。
費用の問題、期間の問題などで一般人には中々難しいようです。
ただし、国際結婚の場合は少し違ってきます。
フィリピンの婚姻に関する法律では
婚姻に関して相手の国の法律に順ずるとなっています。
ですから、日本の様に離婚と言う制度が有る国の人と結婚し
離婚となる場合
日本での離婚完了の諸書類を大使館などに
提出すれば離婚できる事になります。
