私が独自に考案・文書化してきた「SPACEDEBRIS卍Q-AI」および「卍ICARUS」等の宇宙分散コンピューティング/分散AIネットワーク構想について、後に米国側から公表された宇宙コンピューティング関連構想との間に重要な類似点が存在する可能性があり、知的財産法上の評価および今後の対応についてご相談したく、ご連絡いたしました。
本件について、単に「類似するアイデアが後から発表された」という理由だけで、盗作や権利侵害を断定する意図はありません。
私が特に専門家に確認していただきたいのは、以下の点です。
① 私の構想がいつ成立・文書化されていたのか
② その構想および関連資料がいつ外部へ公開または提供されたのか
③ 後発構想が公表される以前に、Elon Musk氏側へ関連資料および情報を送付していた事実を、法的にどのように評価できるのか
④ 私の構想と後発構想との技術的類似性が、単なる抽象的アイデアの一致なのか、それとも法的保護の対象となり得る具体的な技術表現、構成、アーキテクチャ等にまで及んでいるのか

「法的に保護され得る対象が存在するのか」
「米国法および日本法上、どのような権利または請求原因を検討できるのか」
「現時点で証拠として不足しているものは何か」
「米国・日本のどちらで、どのような対応を取ることが適切なのか」

Dear Counsel,
My name is Koji Okamoto, Representative of 卍TECHNOLOGIES in Japan.
I am contacting you to request an initial legal evaluation concerning potential intellectual property and related claims involving original concepts that I developed and documented, including “SPACEDEBRIS卍Q-AI” and “卍ICARUS.”
These concepts concern space-based distributed computing, distributed artificial intelligence networks, autonomous computing nodes, and related space-computing architectures.
Subsequently, space-computing concepts were publicly disclosed in the United States that appear to contain potentially significant similarities to elements of my earlier work.
I am not asserting that the existence of similar ideas, by itself, establishes plagiarism, misappropriation, or intellectual property infringement.
Rather, I am seeking an objective legal assessment from experienced intellectual property litigation counsel.
In particular, I would like counsel to evaluate:
1. When my concepts were originally conceived, documented, and reduced to written materials;
2. When those concepts and related materials were publicly disclosed or otherwise provided to third parties;
3. The potential legal significance of the fact that materials relating to these concepts were sent to the Elon Musk side before the subsequent concepts were publicly announced; and
4. Whether the technical similarities involve merely abstract ideas or extend to sufficiently specific technical expressions, structures, architectures, or other legally protectable subject matter.
I retain original documentation and supporting records, including web publication records, communications, materials that were transmitted, postal shipment records, and delivery records.

At this stage, I am not asking counsel to assume that plagiarism or intellectual property infringement has occurred.
Instead, I would like an objective assessment of whether the available facts and evidence could support any viable legal claims, including, where applicable:
• Copyright infringement or protection of original expression;
• Patent-related issues and rights concerning inventions or technical concepts;
• Trade secret and confidential technical information issues;
• Misappropriation or misuse of technical information, know-how, or ideas;
• Unfair competition claims;
• The legal significance of prior disclosure or transmission of the materials;
• Potential causes of action under U.S. law;
• Potential causes of action under Japanese law;
• Evidence-preservation measures;
• Issues relevant to potential U.S. discovery;
• Pre-litigation inquiries, notices, negotiations, or demands; and
• Whether litigation or another legal proceeding should reasonably be considered.
Because this matter potentially involves artificial intelligence, distributed computing, satellite systems, space computing, and U.S.-based entities or individuals, I believe it may require analysis as a complex technology and cross-border intellectual property dispute rather than solely as a conventional copyright matter.
For an initial evaluation, I can organize and provide relevant evidence chronologically, including:
• Original concept documents;
• Records establishing creation dates;
• Records establishing online publication dates;
• Copies of materials previously transmitted;
• Email and other communication records;
• Postal shipment records;
• Delivery records;
• Publicly available materials concerning the subsequently announced concepts; and
• A technical claim/comparison chart identifying similarities and differences between the respective architectures.
I would initially like your assessment of the following questions:
1. Is there legally protectable subject matter reflected in my materials?
2. What viable claims, if any, may exist under U.S. and/or Japanese law?
3. What additional evidence would be required to evaluate or pursue those claims?
4. Which jurisdiction and legal strategy would be most appropriate?
Given the potential scale and international nature of this matter, I would also appreciate your consideration of whether your firm might evaluate the case under a contingency fee arrangement, hybrid contingency arrangement, success-fee structure, or another alternative fee arrangement.
Would your firm be willing to conduct an initial case evaluation and consider possible representation?
If so, please advise what materials you would require for your initial review and the appropriate next steps.
