On Monday, the Trade Ministry in Seoul reacting to Washington's decision to block a ruling the U.S. Trade Commission ITC in favor of South Korean Apple rivals at the last minute. President Barack Obamas of Trade Representative Michael Froman had the veto decision justified on Saturday in particular, that the ITC ban was based on a patent from the basis of technical standards. Special FRAND apply such standard patents rules ("fair, reasonable and non-discriminatory terms) so they must be licensed under fair conditions and without discrimination against competitors. The US Government and the EU Commission are against bans on sales on the basis of such patents.
The escalating since spring 2011 patent conflict between the two leading smartphone manufacturers will take place in about a dozen countries. Apple provides design and features of the Samsung devices iPhone copied and therefore moved to court. However, the affected Apple patents do not fall within the class of FRAND patents. Samsung countered with own plagiarism allegations, which relate in particular to technical patents, are often part of standards. In the EU, after proceedings of the Commission in Brussels, Samsung already withdrew requests for bans on sale based on such patents.
The ITC had decided in early June that a mobile patent will hurt by Samsung by five Apple products. The ban on imports should come into force on Monday. However, only versions of older Apple devices, like the iPhone 4 and iPhone 3 were affected. One of the ITC judges disagreed at the time, because it went to a standard patent.
It will monitor closely the further decisions of the ITC in the patent dispute, according to the statement of the South Korean Trade Ministry. Seoul hope on "fair and reasonable" decisions. The ITC wants to decide in a proceeding until August 9 about an import ban for Samsung devices after Apple charges.
Apple and Samsung had appealed both against the ITC decision by June. The South Koreans saw hurt more patents by best android phones . The company had appealed against the ITC ruling at the Court of appeals for the Federal Circuit in Washington according to the data, on 18 July. A hearing to do this, however, is only for planned early next year.
