要約:被告○○○は、平成○○年○月○日、○○ホテル321号室内にて、原告○○○○○が酩酊状態であり同意がないのに、コンドームを付けないで挿入した。そのため、原告○○○○○は、翌日病院に行ってアフターピルの処方を受けることとなった。たとえ恋人であっても、同意がないのにコンドームをつけないで挿入した行為は、傷害罪に当たる。よって、被告○○○を懲役3か月執行猶予1年の刑に処する。
