【Court buttock flasher Dr Megumi Ogawa loses latest bid against deportation by perth now】

A JAPANESE law lecturer jailed for contempt after flashing her buttocks while on trial for threatening to kill Federal Court officials has lost her latest legal bid to remain living in Australia.

The Queensland Civil and Administrative Tribunal has ordered complaint application lodged by Dr Megumi Ogawa, 45, to the Anti-Discrimination Commission Queensland on December 14 last year be rejected.

QCAT senior member Clare Endicott, in a just published three-page written decision, has directed the tribunal's registrar reject Ogawa's application.

Ms Endicott said QCAT's registrar - who has the responsibility to accept or reject applications filed with the tribunal - had correctly rejected Ogawa's application.

"Dr Ogawa made a complaint ... (and it) was rejected under section 139 of the Anti-Discrimination Act 1991 on the basis that her complaint was lacking in substance,'' she said.

"The tribunal directs the Principal Registrar to reject the application.''

Ogawa's failed QCAT application is the latest in a long list of court actions which saw her jailed for threatening Federal Court staff and contempt of court for her appalling and outrageous behaviour during her Brisbane District Court trial.

In August 2010, the Hight Court of Australia refused Ogawa leave to appeal her conviction and sentence for contempt - which included mooning a journalist from The Courier-Mail in open court.

She also lost earlier bid to overturn her conviction in Queensland's Court of Appeal.

It took almost two years to hear Ogawa's case after many preliminary court appearances in which her fitness to stand trial was often questioned.

District Court judge Stuart Durward, SC, sentenced Ogawa in March 2009 to four months' jail for contempt, a Queensland offence, and six-months for four Commonwealth offences.

A jury found Ogawa guilty of two counts of using a carriageway to harass and two counts of threatening to kill on various dates between April 12 and May 19, 2006.

Judge Durward charged Ogawa with the contempt for her "disgraceful'' behaviour moments after the jury delivered its verdict for the Commonwealth offences.

"Your behaviour in court has been disgraceful,'' Judge Durward said.

"You demonstrated you did not want the trial to commence or proceed.''

He said it was unlikely any court in Queensland had ever been witness to such appalling behaviour before.

Ogawa's behaviour included screaming loudly, claiming she was about to soil herself, trying to disrobe and exposing her buttocks to a journalist while being dragged into court in handcuffs and demanding potential jurors help her because "white Australians (were) trying to kill'' her.

Ogawa, in the wake of the QCAT decision, is again likely to face possible deportation to Japan.
