C’s (Coalition for Legislation to Support Citizen’s Organizations) released
“Nintei NPO Shutoku Support System” on December 21, 2012.
The “Nintei NPO Shutoku Support System” is the cloud system that will assist
NPOs to become Nintei NPO (certified NPO organizations). By answering questions
one by one, 1) can check if an NPO meets the criteria to become Nintei,
2) online questions and answers are available, 3) one can prepare documentation.
NPOs (Specified Nonprofit Corporations) are incorporated organizations under
NPO law, and Nintei NPOs (certified NPO organization) are eligible to receive
tax benefits. Individual donors can receive tax credits up to 50 %, and
Nintei NPOs themselves can reduce the taxable amount for their business income.
There are over 1700 NPOs in Iwate, Miyagi, and Fukushima, however, only four
organizations have applied for Nintei since April 2012.
C’s released this system to help support NPOs in the Tohoku disaster area
(Iwate, Miyagi, and Fukushima) for free, and to assist those NPOs become
Nintei and take advantage of tax benefits. Those NPOs who become Nintei
will help rehabilitation and reconstruction of the disaster area in the
long term.
What is unique about this system is that NPOs can automatically receive
feedback on their eligibility just by following and answering questions online.
Plus, those answers are available for the documents which they would need
when applying to become Nintei. NPOs do not need to bother understanding
every detail of the tax code. If they have any questions, C’s will answer
using electronic bulletin boards unique to each NPO. NPOs can apply for
Nintei without worrying about support.

C’s is dedicated to passing legislation and building support structures
to strengthen the civil sector in Japan since 1994. These activities have
ranged from a law for promoting the activities of non-profit organizations
to preferential tax measures. After achieving significant revision of
laws affecting nonprofits in 2011, C’s has put efforts toward getting
nonprofit access to the benefits of this new legislation.

今年３月中旬のことになりますが、twitterでシーズ松原が
漫画HUNTER×HUNTER（ハンター×ハンター）の話題をつぶやきました。
少年ジャンプに連載されている漫画です。
読まれました？
HUNTER×HUNTER（ハンター×ハンター）というのは、
主人公の少年ゴンがプロの「ハンター」になって、様々な冒険を繰り返すストーリー。
富樫義博さんの人気漫画です。
その一コマには、こんな風です。
「信頼に足る団体 しかも自費での調査しか許されない状況だった」
「オレは逆にチャンスだと思った」
「１５の時に特定非営利活動法人を設立して王墓の調査と修繕を行った」
「「金も名誉もいらないから ただ真実を知りたい」っていう変わり者で、
さらに口が堅くて信頼できる連中が法人設立のため１０人必要だったからな。」
「特定非営利活動法人」にもちゃんと、“ふりがな”がふられてましたよ。
少年漫画ですからね。

⇒なるほど、任意団体でいるよりも、法人格があったほうがいいですね。

事業収入がある団体の場合、このメリットは見逃せません。
法人税の軽減ができるんですよ！
ＮＰＯ法人であっても、３４業種に該当する収益事業を行うと、課税対象となりますが、
収益事業から得た利益を本来目的の非収益事業に使用した場合に、
この分を寄付金とみなし、一定の範囲で損金に算入できるという制度です。
収益事業に係る法人税が軽減されます。
みなし寄付金の控除上限額は今回の改正で、
所得の５０％か２００万円のいずれか高い方に拡充されました。
認定ＮＰＯ法人になることは、寄付者だけでなく、
法人自身にとってもメリットがあります。
さあ、認定ＮＰＯになろう！
