Bioenergy of America Files for Ch. 11

Fuel Maker Bioenergy of America Sputters, Files for Bankruptcy

Biodiesel fuel maker Bioenergy of America Inc. has filed for Chapter 11 bankruptcy, becoming the latest company to stall out on the road in search of a cleaner alternative to oil and gas.

The Edison, N.J.-based company listed assets of between $1 million and $10 million and debts of between $10 million and $50 million, in its Chapter 11 petition filed Thursday with the U.S. Bankruptcy Court in Trenton, N.J.

Bioenergy of America, which produced 15 percent of all the biodiesel sold in the United States in 2005, didn't say what prompted the bankruptcy filing in its Chapter 11 petition filed with the court. Officials at the privately held company didn't return calls seeking comment.

However, in the last year, prices for the crops that make most biodiesel have doubled. Biodiesel can be produced from animal fats or vegetable oil. But in the United States, the vast majority of biodiesel is made from soy oil. Soy oil prices rose nearly 50 percent in the last year.

Although oil and other energy prices increased dramatically in the past year, biodiesel prices _ hurt by increased production coupled with lack of domestic demand _ haven't kept up.

Rising costs and sluggish demand have put pressure on producers.

In July, a group of hedge funds that claimed Earth Biofuels Inc. hasn't been paying its debts on time, tried to force the company into bankruptcy.

A federal judge later dismissed the bankruptcy after the company, which distributes country music star Willie Nelson's BioWillie biodiesel fuel, agreed to an interim restructuring deal put forth by a group of hedge funds.

In Europe, where diesel cars remain popular, Biofuels Corp. narrowly avoided bankruptcy after Barclays Bank agreed to swap some of its debt a controlling stake in the company. Biofuels blamed high commodity prices and biodiesel imports from the U.S. for its woes.
