BAYER loses court appeal
The Leverkusen-based multinational has also lost the second round of the suit for damages in the glyphosate affair which the U.S. cancer victim Dewayne Johnson brought against Monsanto. In the initial proceedings in August 2018, the former school janitor won. The jurors ruled unanimously that the pesticide, marketed mostly under the brand label Roundup, had caused his non-Hodgkin’s lymphoma, and awarded him damages.
Yesterday, Monday, a court in San Francisco confirmed this verdict against Bayer’s subsidiary Monsanto. It merely lowered the amount of damages from 78 million dollars to 20.5 million dollars. The Court of Appeal of the State of California allotted 10.25 million dollars as damages for pain and suffering for Johnson, and 10.25 million dollars as punitive damages against Bayer.
‟In our opinion, Johnson presented extensive – and substantial – proof that glyphosate, together with other ingredient in Roundup products, led to his cancer,” the judges found. ‟Expert after expert presented evidence that Roundup products can initiate the non-Hodgkin’s lymphoma in principle (…) and specifically triggered Johnson’s cancer,” they wrote in the grounds for their verdict. The judges rejected the Bayer lawyers’ demand that such assessments be disqualified as ‟minority opinions”.
The court also upheld the ‛punitive damages’ which the U.S. legal system provides for cases of proven serious blame. Monsanto had ‟intentionally and deliberately disregarded the safety of others”, it found.
‟This judgment is a slap in the face for Bayer. The corporation must finally draw the consequences, and take glyphosate off the market, before the herbicide does even more harm,” Marius Stelzmann of the Coordination gegen BAYER-Gefahren (CBG) demanded.
In Stelzmann’s view, the decision by the Court of Appeal casts even more doubt on the recent proposal by Bayer for a settlement of the numerous glyphosate suits that are still pending. ‟Fobbing off the injured parties with small amounts, blocking their resort to the courts, and having scientists first clarify once again whether glyphosate is really harmful to health – the corporation will probably find all these things even more difficult now,” the CBG’s executive secretary predicts.
