The U.S. International Trade Commission banned the South Korean group "to continue to import, sell, and distribute articles that violate" two Apple patents. She, however, rejected the accusations for other four patents. A decision that will take effect in two months that Barack Obama can veto.
The patent war between Apple and Samsung in full swing. Less than a week after seeing a similar decision for its own products canceled by the Obama administration, Apple won Friday sales ban in the United States certain mobile(THL W11 Monkey King
) devices rival he accused Samsung of violating its Patents The ban was decided by the U.S. International Trade Commission (USITC), to which the U.S. computer group had filed a complaint in August 2011 because he believed that some smartphones and tablets of its South Korean competitor copied features of its own flagship products, the iPhone and iPad. The USITC found violations proved for two patents on technologies related to touch screens and detection of accessories such as headphones. The Commission accordingly prohibits Samsung Electronics America and Samsung Telecommunications America "continue to import, sell, and distribute articles that violate" these two patents. The decision does not indicate which Samsung devices are precisely concernés.Le group itself did not say, however, suggesting that the scope would be limited. "We have already taken steps to ensure that our products remain available in the United States," assured a spokesman, without giving details.
The decision of the USITC takes effect anyway after expiry of a period of two months during which President Barack Obama can veto. This right is rarely used, but Washington has been used last Saturday for the first time since 1987. The decision of the USITC also concerned that he canceled a conflict between Apple and Samsung, but this time it was the first devices that were banned because they violated patents of South Korea.
Apple, however, has not won on the line: the U.S. Commission rejected his accusations against Samsung for four other patents. Two focused on the design of the equipment, including the rounded corners that characterize the iPhone and iPad(PIPO M8PRO ). While acknowledging that Samsung was "disappointed" by the decision, the spokesman of the South Korean group has stressed that it "stops Apple's efforts to use its overly broad patents on the form (devices ) to achieve a monopoly on rectangles and rounded corners. " This did not stop Apple to celebrate Friday. "The USITC joined the courts around the world in Japan, Korea, Germany, the Netherlands and California advocating innovation and rejecting blatant copy Samsung Apple products," is it commended in a statement sent by email.
Almost all major technology groups accuse of a continent or other violations of patents. If the majority of battles are played in court, the USITC has received several times, some felt more easy to get a ban on competing products.
The Apple-Samsung battle, the results so far have been very different in different countries, is particularly followed because they are the two dominant players in the markets for smartphones(ThL W8S ) and tablets, and also because through Samsung, Apple to indirectly attack its number one competitor what Google and its Android mobile operating system, used by a variety of manufacturers.
